1. Introduction

Solara Garden ("Solara Garden," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and otherwise process personal information when you visit solara-garden.com (the "Site"), purchase our products, sign up for our emails or SMS messages, contact our customer service, or otherwise interact with us (collectively, the "Services").

This Policy applies to residents of all U.S. states. If you are a resident of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Tennessee, Delaware, New Hampshire, New Jersey, Minnesota, Maryland, Indiana, Rhode Island, Kentucky, or any other U.S. state with a comprehensive consumer privacy law, additional rights apply to you. By using the Services, you acknowledge the practices described in this Policy.

2. Personal Information We Collect

We collect the following categories of personal information:

  • Identifiers: name, email address, postal address, phone number, account username, IP address, device identifiers, online identifiers, cookie IDs, advertising IDs.
  • Customer records: billing address, shipping address, order history, payment card information (processed by our payment processor — we do not store full card numbers).
  • Commercial information: products purchased, products viewed, items added to cart, wishlists, subscription status, returns, customer service interactions.
  • Internet and network activity: browsing history on the Site, search history, pages viewed, clicks, referring URLs, time spent on pages, device and browser type, operating system, language preferences, interaction with our emails (opens, clicks).
  • Geolocation data: approximate location derived from IP address; precise location only if you grant permission through your device.
  • Audio, visual, or similar information: photos or videos you submit (e.g., reviews, customer service inquiries), recordings of customer service calls where permitted by law.
  • Inferences: preferences, interests, characteristics, and behavior derived from the above, used to build profiles for personalization and marketing.
  • Sensory information: product preferences and gardening interests you share with us.
  • Demographic information: age range, gender, household information, or similar attributes where you provide them or where we infer them.
  • Communications: the content of messages you send us by email, chat, SMS, or social media.

We do not knowingly collect Social Security numbers, driver's license numbers, financial account numbers, precise geolocation, biometric identifiers, genetic data, health information, immigration status, union membership, or contents of mail/email/text messages not directed to us.

3. Sources of Personal Information

We collect personal information from:

  • You directly, when you create an account, place an order, sign up for emails, contact us, leave a review, or interact with the Site.
  • Automatically, through cookies, pixels, SDKs, server logs, and similar technologies as you use the Site.
  • Third parties, including payment processors, shipping carriers, marketing partners, advertising networks, analytics providers, social media platforms, fraud prevention vendors, data enrichment providers, and publicly available sources.

4. How We Use Personal Information

We use personal information for the following business and commercial purposes:

We may combine personal information collected from different sources and use it for any of the purposes above.

5. How We Share Personal Information

We disclose personal information to the following categories of recipients:

  • Service providers and processors: payment processors, shipping carriers, fulfillment warehouses, IT and hosting providers, customer service platforms, email and SMS service providers, analytics providers, fraud prevention vendors, return processors, and similar vendors acting on our behalf.
  • Advertising and marketing partners: advertising networks, social media platforms, ad-tech vendors, attribution providers, and lookalike-audience partners. Some of these disclosures qualify as a "sale" or "sharing" of personal information under certain state laws. See Section 6.
  • Analytics providers: including Google, Meta, and similar platforms that help us understand how the Site is used and how our marketing performs.
  • Affiliates and subsidiaries of Solara Garden.
  • Professional advisors: accountants, lawyers, auditors, and consultants.
  • Successors in interest: in connection with a merger, acquisition, reorganization, financing, sale of assets, bankruptcy, or similar transaction.
  • Government authorities and other parties when required by law, in response to legal process, to protect our rights, property, or safety or that of others, or to investigate fraud or security incidents.
  • With your consent or at your direction.

We do not sell personal information for monetary consideration in the traditional sense, but our use of online advertising and analytics technologies may constitute a "sale" or "sharing" of personal information under California, Colorado, Connecticut, and other state laws. You can opt out as described in Section 12.

6. "Sale" or "Sharing" of Personal Information; Targeted Advertising

Some U.S. state privacy laws define "sale" and "sharing" broadly to include disclosures of personal information to third parties for cross-context behavioral advertising, even without monetary exchange.

Under those broad definitions, we do "sell" and "share" the following categories of personal information: identifiers, internet and network activity, commercial information, geolocation (approximate), and inferences. We disclose these categories to advertising networks, social media platforms, and analytics partners for purposes of targeted advertising and measurement.

We do not knowingly sell or share the personal information of consumers under 16 years of age.

You have the right to opt out of this activity. See Section 12 and our "Do Not Sell or Share My Personal Information" and "Your Privacy Choices" link in the Site footer.

7. Sensitive Personal Information

We do not intentionally collect or use sensitive personal information (as defined under applicable state law) for purposes that would require offering a "Right to Limit." If we did process sensitive personal information for purposes beyond those permitted without an opt-out, we would provide a "Limit the Use of My Sensitive Personal Information" link.

8. Cookies, Pixels, and Similar Technologies

We and our partners use cookies, web beacons, pixels, SDKs, local storage, and similar technologies to:

  • Make the Site function (essential cookies)
  • Remember your preferences
  • Analyze traffic and performance
  • Personalize content
  • Deliver and measure advertising, including cross-site and cross-device

You can manage cookie preferences through our cookie banner (where available), your browser settings, or through industry opt-out tools such as the Digital Advertising Alliance (optout.aboutads.info), the Network Advertising Initiative (optout.networkadvertising.org), and the Global Privacy Control. Disabling cookies may affect Site functionality.

9. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including providing the Services, complying with legal obligations, resolving disputes, enforcing our agreements, defending against legal claims, and supporting business operations. Retention periods vary by data type and use, and may extend beyond the duration of your relationship with us where reasonably necessary.

10. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

11. Children's Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will delete it. We also do not knowingly sell or share personal information of consumers under 16 without affirmative opt-in consent as required by law.

12. Your Privacy Rights

Depending on your state of residence, you may have some or all of the following rights:

  • Right to Know / Access: confirm whether we process your personal information and request a copy of it, including the categories collected, sources, purposes, and categories of third parties to whom it has been disclosed.
  • Right to Delete: request deletion of personal information we have collected from you, subject to legal exceptions.
  • Right to Correct: request correction of inaccurate personal information.
  • Right to Data Portability: receive a copy of your personal information in a portable, readily usable format.
  • Right to Opt Out of Sale/Sharing: opt out of the sale or sharing of your personal information.
  • Right to Opt Out of Targeted Advertising: opt out of processing personal information for targeted advertising.
  • Right to Opt Out of Profiling: opt out of profiling in furtherance of decisions that produce legal or similarly significant effects (we do not currently engage in such profiling).
  • Right to Limit Use of Sensitive Personal Information: direct us to limit use of sensitive personal information to certain permitted purposes.
  • Right to Non-Discrimination: we will not discriminate against you for exercising any of these rights.
  • Right to Appeal: appeal a denial of your request (see Section 14).

State-Specific Disclosures

California (CCPA/CPRA): California residents have the rights to know, delete, correct, opt out of sale/sharing, limit use of sensitive personal information, and non-discrimination. Below are the categories of personal information we have collected, sold/shared, and disclosed for a business purpose in the past 12 months:

  • Collected: identifiers, customer records, commercial information, internet/network activity, approximate geolocation, audio/visual information, inferences, demographic information, communications.
  • Sold or shared: identifiers, internet/network activity, commercial information, approximate geolocation, inferences (for cross-context behavioral advertising).
  • Disclosed for a business purpose: all categories listed above, to service providers and contractors.

California residents may submit requests through the methods in Section 13 and may use an authorized agent (Section 15).

Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Tennessee, Delaware, New Hampshire, New Jersey, Minnesota, Indiana, Rhode Island, Kentucky: Residents of these states have rights to access, delete, correct (where applicable), portability, and opt out of sale, targeted advertising, and certain profiling. Utah does not provide a right to correct or appeal. Iowa does not provide a right to correct or to opt out of targeted advertising as a standalone right.

Maryland (MODPA): In addition to the standard rights, Maryland residents are protected by stricter data-minimization requirements, and we will not sell sensitive personal data or process the sensitive data of known minors for targeted advertising.

Nevada: Nevada residents have a separate right to opt out of the sale of certain covered information. Submit requests using the methods in Section 13.

Other states: As additional state privacy laws take effect, we will honor the rights they grant to their residents.

13. How to Exercise Your Rights

We will verify your request by matching information you provide with information we already maintain. We may need additional information to verify your identity. We will respond within the timeframes required by applicable law (generally 45 days, with one possible extension).

14. Appeals

If we deny your request, you may appeal the decision by replying to our denial email or by contacting privacy@solara-garden.com with the subject line "Privacy Rights Appeal." We will respond within the timeframe required by your state's law (generally 45–60 days). If your appeal is denied, you may contact your state attorney general.

15. Authorized Agents

You may use an authorized agent to submit a request on your behalf. We will require written authorization from you, verification of the agent's identity, and verification of your own identity before processing the request.

16. Universal Opt-Out and Global Privacy Control

We honor recognized universal opt-out signals, including the Global Privacy Control (GPC), as required by California, Colorado, Connecticut, and other applicable states. When we detect a valid opt-out signal from your browser, we will treat it as an opt-out of sale and sharing for that browser or device.

17. Third-Party Links and Services

The Site may contain links to third-party websites, plug-ins, and services. This Policy does not apply to those third parties. We are not responsible for their privacy practices, and we encourage you to review their policies.

18. International Users

The Services are intended for users located in the United States. If you access the Services from outside the U.S., your information will be transferred to and processed in the United States, which may have data protection laws different from those in your country.

19. Changes to This Policy

We may update this Policy from time to time. The "Last updated" date at the top reflects the most recent version. Material changes will be communicated through the Site or by other reasonable means. Continued use of the Services after changes take effect constitutes acceptance.
